What a Fatal Auto Accident Claim Entails

Have a Pawtucket fatal car accident lawyer handle your claim. Your attorney can explain the mistakes that can lose your Rhode Island car accident case and how to avoid them. On top of that, they can communicate and collaborate with insurance companies on your behalf.

Your attorney may engage in insurance settlement negotiations for you. They want you to receive a settlement that encompasses the quantifiable and subjective losses relating to your family member’s fatal auto accident. If no such offer is made, they may advise you to proceed with a wrongful death lawsuit.

Per Rhode Island General Laws § 10-7-2, if you are eligible to file a wrongful death lawsuit, you may have up to three years from a person’s death to do so. Generally, this lawsuit can be filed by the administrator or executor of the deceased’s estate.

What Can Happen If You File a Fatal Car Accident Lawsuit

Leading up to your trial, your car accident attorney can gather witness statements, crash scene photos and videos, police reports, medical records, and other evidence to support your case. Simultaneously, they may negotiate a settlement with the defendant.

Your lawyer wants you to do what you feel is necessary to cope with your grief after a car accident in which you lost a member of your family. Ideally, they get you a settlement that covers the losses from your family member’s death. At the same time, they can continue to prepare your case for trial.

In a trial, your attorney can argue your case in front of a judge or jury and explain why the defendant should be required to pay damages. Meanwhile, they can dispute any claims that the defendant makes. The court will consider both parties’ perspectives when deciding your case. If the court rules in your favor, you may recover economic and non-economic damages.

Damages That You Could Get in Your Fatal Auto Accident Case

Your wrongful death attorney is focused on getting you the results that match your expectations. As such, they can assess the losses that you face relating to your loved one’s death. Based on these, your lawyer may help you secure any of the following types of damages:

• Your loved one’s medical bills from before their death
• Emotional distress, physical discomfort, and other pain and suffering that your loved one may have experienced before their death
• Your loved one’s burial and funeral expenses
• Loss of companionship
• Lost wages

You may believe that you have a strong case for damages. Regardless, the defendant may describe to a judge or jury how your loved one may be partly liable for their death. If the defendant’s case resonates with a judge or jury, this may impact the damages that you recover.

What Negligence Means in a Fatal Car Crash Case

Negligence may be the deciding factor in your case against a motorist, a mechanic, a government entity, or any other parties that may be liable for your loved one’s fatal car crash. Your lawyer may develop an argument centered on negligence, since doing so may prompt the court to award damages.

To show negligence, your attorney may highlight how the defendant violated a duty of care, which may have contributed to your loved one’s fatal auto accident. Along with this, they may provide the court with your loved one’s medical bills, pay stubs, and other forms of proof to detail how their death is impacting you and your family financially.

According to Rhode Island General Laws § 9-20-4, pure comparative negligence can affect your case outcome. If the court rules that your loved one was partly liable for their auto accident, your damages can be reduced by their percentage of fault. For example, if your loved one is found to be 20% at fault, you may get 80% of the damages that you initially sought.
